Oliver advises clients on a wide range of commercial disputes and on insolvency.

Oliver is a specialist in insolvency litigation. He advises companies and individuals on all aspects of insolvency and regularly acts for creditors and insolvency practitioners both in relation to the protection and realisation of assets.  This work has included tracing claims and claims against directors. Oliver also advises in relation to directors disqualification.

Oliver has special interest in logistics disputes, including transport, freight forwarding and distribution.  He also advises on agency and franchise agreements, restraint of trade covenants and product liability. Oliver is also experienced in obtaining injunctions for the preservation and recovery of assets.

Joseph Kean

Joseph Kean - Partner

 

Practice Area: Dispute Resolution
Joseph became a solicitor in 1990 and remained with Frere Cholmeley, where he had trained, until its merger with Eversheds in London in 1998.  He became a partner at Eversheds in 2001 and joined Mundays in 2009.  He has throughout his career practised in commercial litigation and arbitration, working in a wide variety of industry sectors.  Some examples of the work which he has done more recently are given below:

 - acting for a major distributor of luxury jewelry in a variety of disputes including distributorship contracts and other matters

- dealing with several sets of proceedings in the aviation field including engineering and leasing disputes and the recovery of aircraft and parts

 - acting for British Nuclear Fuels Ltd in two major and lengthy sets of proceedings concerning contracts with foreign nuclear power plant operators for the reprocessing of their spent fuel at Sellafield

- acting both for and against defendants in professional negligence proceedings involving accountants, lawyers, valuers and surveyors

- and in many sets of complex international proceedings involving issues of foreign law and practice, jurisdiction and priority of proceedings

Nick Martyn

Nick Martyn

 

Practice Area: Dispute Resolution
Nick advises and represents a broad range of both corporate and private clients in all areas of commercial and residential property dispute resolution.  This includes advising on commercial lease disputes and tenancy issues, dilapidations, restrictive covenants, statutory obligations, forfeiture and possession actions. 

Nick has also undertaken work in niche areas of property litigation and has advised clients on leasehold enfranchisement matters, including compulsory acquisition actions and developers on their obligations under the Landlord and Tenant Act 1987 relating to tenants’ right of first refusal.

Fiona McAllister

Fiona McAllister – Partner

 

Practice Area: Dispute Resolution
Fiona is head of the Dispute Resolution Department which incorporates within it the firm’s Employment Law Unit. Fiona has many years experience of dealing with commercial and private disputes.

Fiona particularly deals with disputes between shareholders and partners, warranty claims and on breach of restrictive covenants. She has a post graduate diploma in advanced legal practice taken in the specialist field of employment law, and practices in both contentious and non-contentious aspects of this area of law, advising primarily corporate clients and senior executives.

Fiona is listed in the Legal 500 as an employment lawyer having a “top reputation”  as a recommended lawyer for Commercial Litigation

Stephen Morris

Stephen Morris – Partner

 

Practice Area: Dispute Resolution
Stephen heads the Property Disputes team, which deals with a broad range of issues arising from the ownership, letting and occupation of commercial and residential property. His aim is to work closely with businesses and private clients to identify their objectives and strive to achieve them in the most appropriate and cost-effective manner, whether through litigation or negotiation. Stephen is a trained mediator.

Stephen also deals with disputes in respect of wills, probate and trusts and advises on professional negligence claims arising out of his specialist practice areas.
