James specialises in advising on commercial disputes, including contracts and their resolution via negotiation/mediation/expert determination/arbitration and litigation, Intellectual Property (involving issues of, copyright, design right, trade mark (including use of AdWords and Keywords), registered design, patents, passing off, parallel imports, domain name disputes and confidential information issues), Information Technology (mainly over disputes concerning software) and Franchising (advising both franchisors and franchisees), for which he is mentioned in The Legal 500.
James also has considerable experience advising on issues covering health and safety, insurance/re-insurance, bank guarantees, professional negligence, warranty claims, completion accounts, TV & media, compromise agreements, sports law, commercial agents, defamation, the Charity Commission, disputes with water utility companies, debt actions and lien disputes.
Mundays is a member of CICERO™, an established network of 36 international independent law firms which provides James with regular involvement in disputes in a number of jurisdictions around the world.
James heads up the Franchising Team at Mundays and is a leading lawyer in dispute resolution. He joined the firm in 2002, becoming a partner in 2006 having previously practiced in the Litigation department at City firm Berrymans Lace Mawer.
Recent experience includes;
- Commercial contracts - James advised one of the parties involved in the multimillion pound claim by various supermarkets of their suppliers following the alleged contamination of car fuel supplied to thousands of motorists in 2007.
- Intellectual Property - Resolving a transatlantic dispute concerning patents, the pursuit of an injunction for trade mark infringement.
- Information Technology – Advising in an Arbitration with its seat in Belgium on a major dispute between a telecommunications company and a software company which resulted in a clean sweep award for his client
- Health & Safety –advising an international company in criminal and civil proceedings following the death of a user of their heavy plant machinery, and representing a building company accused of unsafe excavation works.
- Insurance/Re-insurance – defending a re-insurance claim brought by an Italian re-insurance company; and the pursuit of a claim emanating out of Columbia against a Lloyds syndicate surrounding a dispute over key man insurance.
