Divorce and Dissolution of Civil Partnerships

At Mundays we understand that it is a difficult time when a marriage or civil relationship breaks down and people often feel at their most vulnerable.

Picking up the phone to make an appointment to see a family lawyer can be hard.

At Mundays you will always initially speak to a Partner or lawyer in the family department who will talk you through any urgent concerns and make an appointment for you to come in and meet with one of us.

All the lawyers in our family department are members of Resolution. Resolution is an organisation of family lawyers with the objective of trying to resolve family disputes in a non confrontational way.  That does not mean we are not firm when we need to be.

If it is appropriate for a divorce Petition to be issued on the basis of “behaviour” or “adultery” (usually in cases where there has not been a period of separation) we will explain why it is “best practice” to draft particulars of behaviour mildly and not necessary to name a “Co-Respondent” and we will try to agree the wording of the Petition with your Spouse in order to proceed as amicably as possible.

Occasionally it is necessary to issue a Petition very quickly; for example, if it is important to issue a Petition in this country in order to secure a better financial deal for you or if there is a risk of your spouse issuing a Petition in a less favourable jurisdiction. We are always alert to that possibility and have much expertise in dealing with International cases and can help advise on the best forum for your divorce.

We will always look after our client’s best interests but also we will try to help our clients to consider what is in the best interests of the family as a whole, and particularly in order to minimise any distress for the children.
